TSCA vs CPSC: What Hong Kong Exporters Must Know Before Shipping to the USA

TSCA (Toxic Substances Control Act) and CPSC (U.S. Consumer Product Safety Commission) are distinct U.S. federal regulatory frameworks that both affect importers and shippers of goods into the United States, especially chemicals, chemical-containing products, and consumer goods.

TSCA (Toxic Substances Control Act)

• Administered by the U.S. Environmental Protection Agency (EPA).
• Primary U.S. law regulating chemical substances and mixtures to protect human health and the environment from unreasonable risks.
• Covers manufacture (including import), processing, distribution, use, and disposal of chemical substances.
• Key features:
  • Maintains the TSCA Chemical Substances Inventory (tens of thousands of existing chemicals).
  • Requires Premanufacture Notices (PMNs) for new chemicals not on the Inventory before commercial manufacture/import.
  • Allows EPA to require testing, issue Significant New Use Rules (SNURs), restrict or ban substances that present unreasonable risk (e.g., certain uses of PCBs, asbestos, specific existing chemicals), and set rules under sections 4–8 and others.
  • Excludes substances primarily regulated under other laws (e.g., pesticides under FIFRA, foods/drugs/cosmetics under the FD&C Act, certain nuclear materials).

Import requirements (Section 13): Importers (or their agents) must file a certification with U.S. Customs and Border Protection (CBP), typically electronically via the Automated Commercial Environment (ACE):

• Positive certification: “I certify that all chemical substances in this shipment comply with all applicable rules or orders under TSCA…”
• Negative certification: “I certify that all chemicals in this shipment are not subject to TSCA” (for clearly excluded categories such as pesticides, foods, drugs, cosmetics, etc., when not otherwise identified).

Certification generally applies to chemical substances in bulk or as part of mixtures. For articles (finished products), certification is usually not required unless a specific TSCA rule applies (examples include certain composite wood products under TSCA Title VI formaldehyde standards). Non-compliance can result in detention or refusal of entry.

CPSC (Consumer Product Safety Commission)

• Independent federal agency established under the Consumer Product Safety Act (CPSA) of 1972 (strengthened by the Consumer Product Safety Improvement Act / CPSIA and other statutes).
• Mission: Protect the public from unreasonable risks of injury or death associated with consumer products (thousands of product categories, including toys, children’s products, household goods, apparel subject to flammability rules, electronics, etc.).
• Tools include mandatory safety standards, bans, recalls, third-party testing/certification requirements (especially for children’s products), labeling, import surveillance, and enforcement.

Import relevance: Importers of regulated consumer products must ensure compliance with applicable CPSC rules and, for many products, issue certificates of compliance (General Certificate of Conformity / GCC or Children’s Product Certificate / CPC based on testing). As of July 8, 2026, eFiling of certificate data is mandatory for regulated consumer products at the time of entry (via CBP systems), giving CPSC earlier visibility. This does not create new testing obligations but requires electronic transmission of existing certificate information. Foreign Trade Zone entries have a later phase-in (January 2027 in some cases).

How They Relate

• Different primary focuses: TSCA targets chemical substances and their risks across the lifecycle (EPA). CPSC targets finished consumer products and physical/chemical/mechanical hazards to consumers (CPSC).
• Overlap possible: A consumer product can trigger both (e.g., a product containing a TSCA-regulated chemical or subject to CPSC chemical limits such as lead/phthalates in children’s products). EPA and CPSC have information-sharing arrangements, including CPSC access to certain TSCA confidential business information under a long-standing MOU.
• Jurisdiction boundaries: CPSC does not regulate products primarily under other agencies (e.g., foods, drugs, cosmetics under FDA; pesticides under EPA/FIFRA; motor vehicles under DOT). TSCA defers where other statutes effectively manage the risk.
• For logistics/shipping businesses: Both regimes place significant responsibility on the importer of record. Accurate product classification, supplier documentation, testing/certification where required, and correct CBP filings (TSCA certifications + any CPSC eFiling) are essential to avoid holds, delays, or enforcement actions.

Practical notes for shippers/importers (especially from Asia/Hong Kong routes):

• Verify whether the goods are chemical substances/mixtures (TSCA certification likely needed) versus finished articles (often lighter TSCA burden unless a specific rule applies).
• For consumer products under CPSC jurisdiction, confirm testing, certificates, and eFiling readiness.
• Consult official EPA TSCA pages, CPSC business guidance, CBP ACE requirements, and qualified customs brokers/counsel for specific shipments, as rules can be fact-specific and evolve.
